Purchase Policy
The following purchase and subscription terms and conditions (collectively, “Purchase Policies”), in addition to Network’s Terms of Use (“Terms of Use”) [LINK TO TERMS OF USE] and Network’s Privacy Policy (“Privacy Policy”) [LINK TO PRIVACY POLICY], govern your purchase of a subscription to Network’s online streaming service (the “Streaming Service”) available through the Site (whether hosted and/or streamed by Network or through a third-party service provider) and to the purchase of any other goods (collectively, “Merchandise”) or services at the Site. Terms not otherwise defined herein shall have the same meaning set forth in the Terms of Use.
YOUR AGREEMENT
BY SUBMITTING YOUR ORDER FOR STREAMING SERVICE OR OTHER MERCHANDISE, PRODUCTS OR SERVICES AVAILABLE AT THE SITE, YOU ACCEPT AND AGREE TO THESE PURCHASE POLICIES, THE TERMS OF USE AND THE PRIVACY POLICY.
MODIFICATION
From time to time, Network may modify these Purchase Policies, in Network’s sole discretion, without notice to you (to the extent permitted by law), by posting such changes on the Site. In addition, with respect to the Streaming Service, we may modify the terms and conditions specific to the Streaming Service (including, without limitation, the specific games and other content available through the Streaming Service) without notice to you (to the extent permitted by law), by posting such changes on the Site. You should regularly check these Purchase Policies to see if any changes have been made.
The “Last Updated” date at the bottom of these Purchase Policies will indicate when the latest changes were made. By continuing to access and use the Streaming Service or otherwise making a purchase after the Purchase Policies have been modified, you are agreeing to any such modifications contained therein. If you do not agree to any modifications, you should not make a purchase and/or immediately cease using the Streaming Service and cancel your subscription, as your sole remedy, in accordance with the “Cancellation Policy” below.
STREAMING SERVICE
Eligibility
THE STREAMING SERVICE IS AN EXCLUSIVE SERVICE NOT READILY AVAILABLE TO THE PUBLIC. SUBSCRIPTIONS TO THE STREAMING SERVICE ARE ONLY AVAILABLE TO THOSE USERS WHO ARE CURRENT SUBCRIBERS IN GOOD STANDING OF A CABLE, SATELLITE OR OTHER MULTI-CHANEL VIDEO PROGRAMMING DISTRIBUTOR THAT DISTRIBUTES THE APPLICABLE COMCAST SPORTSNET CHANNEL. THE STREAMING SERVICE IS NOT AVAILABLE TO ANY OTHER CATEGORY OF USERS. PLEASE NOTE THAT NETWORK RESERVES THE RIGHT TO CONFIRM YOUR ELIGIBILITY TO RECEIVE THE STREAMING SERVICE (AT THE TIME OF SUBSCRIPTION AND ANY TIME THEREAFTER), INCLUDING, WITHOUT LIMITATION, BY CONTACTING AND CONFIRMING SUCH ELIGIBILITY WITH THE TV SERVICE PROVIDER YOU DESIGNATED DURING SIGNUP/REGISTRATION. BY OBTAINING A SUBSCRIPTION, YOU SPECIFICALLY AUTHORIZE NETWORK TO CONDUCT SUCH INVESTIGATIONS.
IF AT ANY TIME YOU ARE INELIGIBLE TO RECEIVE THE STREAMING SERVICE, NETWORK RESERVES THE RIGHT TO IMMEDIATELY TERMINATE YOUR SUBSCRIPTION WITHOUT ANY NOTICE TO YOU. ACCORDINGLY, IF YOU ARE INELIGIBLE FOR THE STREAMING SERVICE, DO NOT ATTEMPT TO SUBSCRIBE. IF YOU LOSE YOUR ELIGIBILITY (BY CANCELLING YOUR CABLE OR SATELLITE SERVICE, FOR EXAMPLE), YOU MUST PROMPTLY CANCEL YOUR STREAMING SERVICE SUBSCRIPTION. NETWORK OFFERS NO REFUNDS EXCEPT WHERE REQUIRED BY LAW.
Description
The Streaming Service is a subscription-based service that allows you to access and view certain sports games and other sports-related content online, directly on your personal computer (“Streamed Content”). To view games in HD format, you must first download and install the Streaming Service media player (“Media Player”), a third-party software application that resides on your personal computer. To learn more about the Media Player, please review the “Media Player” section below. Certain portions of the services, including, without limitation, customer service and billing, may be performed by Network’s third-party service provider. The specific games available through the Streaming Service are subject to change at any time, in Network’s sole discretion. You are solely responsible for the purchase and maintenance, at your sole cost and expense, of any additional hardware, software, Internet access, and/or related service access and devices required to access the Streaming Service.
Fees
The applicable and current subscription fees for the Streaming Service (“Fees”) shall be communicated to you prior to purchase. Monthly subscriptions are auto-renewing (based on the date of your initial purchase) throughout the applicable season for the subscribed package (“Season”), but will not roll over into the following year’s Season. Season subscriptions will not auto-renew. Specific Season periods for a particular package are available at the Site. Please note that Seasons are subject to change. Fees are also subject to change at any time, in Network’s sole discretion, and any renewal of the Streaming Service shall be charged at the applicable Fee then in effect. For example, if you are a monthly subscriber to the Streaming Service and you subscribed when the Fee was $15 per month and the price subsequently increases to $20 per month, the immediately following renewal period will be charged at the $20 per month rate.
As more fully described below, by becoming a subscriber to the Streaming Service, you will be charged the Fee for the subscription term that you select during the signup/registration process. You may choose a monthly or Season subscription. When you subscribe to the Streaming Service, your designated payment card shall immediately be charged the entire amount equivalent to the advertised Fee for either the first month of Streaming Service, in the case of monthly subscriptions, or the entire Season of Streaming Service, in the case of Season subscriptions.
Automatic Renewal for Monthly Subscriptions
Monthly subscriptions are billed on a 30-day basis (based on the date of your initial purchase), not on a calendar month basis. Monthly subscriptions will automatically renew at the end of each monthly period for additional, consecutive monthly periods until the end of the then current Season for your subscription package.
BY SUBSCRIBING TO A MONTHLY SUBSCRIPTION, YOU UNDERSTAND AND AGREE THAT THE MONTHLY SUBSCRIPTION WILL AUTOMATICALLY RENEW AFTER THE INITIAL MONTHLY, AND EACH SUBSEQUENT MONTHLY, SUBSCRIPTION TERM ENDS, UNTIL THE END OF THE THEN CURRENT SEASON FOR YOUR SUBSCRIPTION PACKAGE. UNLESS OTHERWISE EXPRESSLY SET FORTH AT THE SITE, EACH RENEWAL WILL BE CHARGED AT THE THEN-CURRENT MONTHLY FEE. YOU HEREBY AUTHORIZE NETWORK TO CHARGE YOUR DESIGNATED PAYMENT CARD FOR EACH RENEWAL MONTHLY TERM AT THE THEN-CURRENT MONTHLY FEE AS IT IS DUE. YOU MAY CANCEL YOUR MONTHLY SUBSCRIPTION AT ANY TIME IN ACCORDANCE WITH THE “CANCELLATION POLICY”.
The same payment card that you used to subscribe initially will be automatically charged based upon your subscription plan for as long as you retain your subscription to the Streaming Service. You cannot update or change the designated payment card used to subscribe to the Streaming Service. If you need to update or change the designated payment card, you must cancel your Monthly subscription and re-subscribe with the updated or changed payment card details. If we cannot process a charge to the existing designated payment card, your access to the Streaming Service may be suspended or terminated.
Notification
We will send a confirmation email to the email address you provided in connection with your subscription. Except where prohibited by law, you agree that Network is not obligated to send you any renewal or advance billing notices indicating that your payment card will be or has been charged.
Cancellation Policy
You may cancel your monthly or Season subscription at any time after your initial signup/registration. To cancel a subscription, you must do so by notifying the service provider via email at Networksupport@rayv.com by 5 pm EST on the last day of your then current subscription term in order to allow Network to process your cancellation request. If you are a monthly subscriber and we receive your cancellation request after such time, you will be automatically charged for the next monthly subscription period, unless the specific Season for your subscription has ended. Provided you cancel in accordance with this “Cancellation Policy”, your monthly subscription will be terminated effective at the end of the then current monthly subscription term. If you are a Season subscriber, you need not send a cancellation request as your account will automatically end after the Season is over and your payment card will not be charged again unless you specifically signup for the following Season subscription. Network will confirm receipt of cancellation requests via email.
DO NOT ASSUME YOUR SUBSCRIPTION IS CANCELLED IN THE ABSENCE OF RECEIVING WRITTEN CONFIRMATION FROM NETWORK.
ALTHOUGH YOU CAN CANCEL YOUR STREAMING SERVICE SUBSCRIPTION AT ANY TIME, PLEASE NOTE THAT IF YOU CANCEL YOU ARE NOT ELIGIBLE FOR ANY REFUND FOR THE CURRENT TERM FOR WHICH YOU ARE SUBSCRIBED (INCLUDING SEASON SUBSCRIBERS), EXCEPT WHERE REQUIRED BY APPLICABLE LAW. IF YOU CANCEL, (I) YOUR STREAMING SERVICE SUBSCRIPTION WILL REMAIN ACTIVE THROUGH THE END OF YOUR STREAMING SUBSCRIPTION TERM, AND (II) YOU WILL HAVE CONTINUED ACCESS TO THE STREAMING SERVICE THROUGH THE END OF YOUR STREAMING SUBSCRIPTION TERM. HOWEVER, YOU WILL NOT BE BILLED AGAIN UNLESS YOU RE-SUBSCRIBE.
Notwithstanding the foregoing, Network reserves the right, BUT NOT THE OBLIGATION, to provide pro-rated refunds to Season subscribers WHO CANCEL THEIR ACCOUNTS on a case-by-case basis, as determined by Network in its sole discretion. in such case, such season subscribers will no longer have access to the streaming subscription after a pro-rated refund is provided.
Network Termination/Suspension Rights
Without limiting Network’s rights and remedies set forth in these Purchase Policies, the Terms of Use and as otherwise provided at law and in equity, Network reserves the right, in its sole discretion, to terminate or suspend any Streaming Service subscription at any time upon the occurrence of any of the following events: (a) you fail to pay or Network cannot charge any Fees when due; (b) you breach these Purchase Policies (as determined by Network in its sole discretion), including, without limitation, subscribing to the Streaming Service when you are ineligible to do so; (c) you breach your representations, warranties or covenants with respect to these Purchase Policies (as determined by Network in its sole discretion); (d) you have made any misstatements to Network; (e) you breach the Terms of Use (as determined by Network in its sole discretion); or (f) Network discontinues the Streaming Service. Network’s remedies are not exclusive but are in addition to all other remedies provided under these Purchase Policies, at law or in equity. Network further reserves the right at any time to modify, interrupt, limit, suspend or discontinue, temporarily or permanently, the Streaming Service, in whole or in part, from time to time without notice, in its sole discretion, including, without limitation, as Network deems necessary for purposes of maintenance, upgrades and the like, to maintain the integrity of the Streaming Service or to comply with applicable law. Network shall not be liable to you or to any third party for any such modifications, suspensions or discontinuances of the Streaming Service.
IF WE TERMINATE YOUR SUBSCRIPTION DUE TO YOUR BREACH OF THESE PURCHASE POLICIES OR FOR ANY DECEPTIVE OR OTHERWISE WRONGFUL ACT, AS DETERMINED BY NETWORK IN OUR SOLE DISCRETION, NETWORK RESERVES THE RIGHT TO NOT PROVIDE A REFUND OF ANY SUBSCRIPTION FEES PAID BY YOU, INCLUDING, WITHOUT LIMITATION, FEES FOR A SEASON SUBSCRIPTION, UNLESS A REFUND IS REQUIRED BY APPLICABLE LAW.
License Grant and Intellectual Property Rights
Upon receipt of payment of the applicable Fee, Network grants to you a limited, revocable, non-exclusive and non-transferable right and license to access the Streaming Service on one personal computer at any given time. The Streaming Service is for your personal and non-commercial use. You acknowledge that you may not sublicense, transfer, sell, or assign this license or the Streaming Service. Any attempts to sublicense, transfer, sell, or assign the license are void. All rights not expressly granted to you herein are reserved to Network and its licensors.
The Streaming Content is the property of Network and/ or its licensors and is protected by United States and international intellectual property laws. As a subscriber of the Streaming Service, in addition to those restrictions set forth in the “User Conduct” section of the Terms of Use with respect to use of Content (as defined in the Terms of Use), you agree that you will use the Streaming Content solely for your personal, non-commercial use. You may not use the Streaming Content in any matter inconsistent with these Purchase Policies, Terms of Use or applicable law, and you may not copy, modify or alter the Streaming Content without Network’s express prior written consent.
Media Player
The Media Player is a web-based application made available by Network’s third party service provider, RayV, Inc., that enables you to view Streaming Content in HD format. Since Network does not make the Media Player available to you, you acknowledge and agree that Network will not have any liability in connection with the Media Player, including, without limitation, availability or functionality issues. In order to download and install the Media Player, you must first agree to the End User License Agreement for the Media Player.
Notwithstanding the fact that the Media Player does not enable downloading or copying of the Streaming Content, by agreeing to these Purchase Policies, you represent that you will not make copies or prints of any Streaming Content accessed via the Media Player under any circumstances, including, without limitation, via downloading and repurposing any screen shots or making use of any form of screen grab applications. The Streaming Service, Media Player, and any Streaming Content, are made available to you only for your personal, non-commercial use.
PAYMENT AND BILLING POLICIES
Payment Forms
You may use the following methods of payment to purchase Streaming Service subscriptions and Merchandise: MasterCard, Visa, American Express and Discover. Network and its vendors do not accept credit or debit cards issued from banks outside the U.S. By submitting a purchase at the Site, you represent and warrant that you have the right and are authorized to use the credit or debit card you designate for purchase such and that the billing and related information you provide is accurate, current and complete.
Authorization for Charges
You acknowledge that Network (or its designee) will, and you hereby authorize Network (or its designee) to, charge your credit or debit card designated in connection with your purchase when we bill you for the total purchase price (including, without limitation, applicable taxes, shipping and handling charges, and other fees) in connection with such purchase, including, without limitation, all current or renewal Fees due to Network in connection with your Streaming Service subscription.
BY DESIGNATING A CREDIT OR DEBIT CARD NUMBER AND RELATED BILLING INFORMATION TO NETWORK, YOU AUTHORIZE NETWORK TO CHARGE THAT DESIGNATED CREDIT OR DEBIT CARD WITHOUT FURTHER OR PRIOR NOTICE TO YOU.
If for any reason, you have not authorized charges to be made to your credit or debit card or your credit or debit card issuer does not pay Network for charges, Network reserves the right to suspend or terminate any associated purchase, including, without limitation, the Streaming Service. All charges are billed in U.S. Dollars and are subject to other fees which your payment card issuer may require.
Your right to use the Streaming Service is conditional upon Network’s receipt of payment. If payment cannot be charged to your credit card or if a charge is refunded for any reason, including chargeback, we reserve the right to immediately and without notice, either suspend or terminate your access and account. You are required to pay any amounts still owed to us at the time your account is suspended or terminated.
To review the billing terms of your Streaming Service subscription, you may access your subscription details via your “MY ACCOUNT” page.
AVAILABILITY
Network does not guarantee the availability of the Streaming Service or any other services. Network may discontinue or otherwise cease offering the Streaming Service or any other services at any time, in Network’s sole discretion.
Minimum Age Requirements
You must be eighteen (18) years of age or older to subscribe to the Streaming Service or otherwise make a purchase. In the event that you reside in a jurisdiction where the age of majority is older than be eighteen (18) years of age, then the minimum age in such jurisdictions shall be the age of majority. If you are not of majority in your jurisdiction of legal residence (and not at least be eighteen (18) years of age), and want to access the Streaming Service or otherwise make a purchase, please ask your parent or guardian to complete the purchase on your behalf.
PRIVACY
In subscribing to the Streaming Service, you will be asked to provide Network personally identifiable information including but not limited to, your first and last names, your street address (including the city, state/province and zip/postal code), your telephone number, your email address and your credit card number. This information will be used by Network and its authorized agents for the purpose of managing your subscription to the Streaming Service, in accordance with the Privacy Policy.
ACCOUNTS, PASSWORDS AND SECURITY
In subscribing to the Streaming Service, you must complete the registration process by providing Network with accurate, current and complete information for your account, as prompted by the signup/registration form. You acknowledge that by providing any information to Network that is untrue, inaccurate, or incomplete, Network has the right to terminate your subscription to the Streaming Service. As part of the registration process, you will be asked to select a username and password. You are entirely responsible for maintaining the security and confidentiality of your subscription account and password.
FURTHERMORE, YOU ARE ENTIRELY RESPONSIBLE FOR ANY AND ALL ACTIVITIES AND CONDUCT BY OR THROUGH YOUR ACCOUNT.
You agree to notify Network immediately of any unauthorized use of your account or any other breach of security. Network will not be liable for any loss or damages of any kind that may arise as a result of someone else using your account, either with or without your knowledge. However, you may be held liable for any losses incurred by Network or another party due to someone else using your account.
NOTICES
Network has the right, but not the obligation, to deliver notice to you under these Purchase Policies by email, a general notice published on the Site or by postal mail to the street address provided by you at the time you become a subscriber. Network will never request any personally identifiable information from you via electronic (or postal) mail. If you receive an email (or postal mail) that purports to be from us that requests personally identifiable information from you, and specifically, your credit card number, please do not reply to that email or request. In the event that your credit card information has expired or does not accept our charge, we shall provide you notice via email, and request you to update your account with new credit card information. We shall only refer to your credit card information via its last four digits.
MERCHANDISE WARRANTIES
NETWORK IS ONLY A DISTRIBUTOR WITH RESPECT TO MERCHANDISE SOLD THROUGH THE SITE. MERCHANDISE SOLD BY NETWORK IS NOT MANUFACTURED BY NETWORK AND NETWORK MAKES NO WARRANTIES IN CONNECTION THEREWITH. MERCHANDISE MAY, HOWEVER, BE COVERED BY EACH MANUFACTURER’S WARRANTY, SERVICE, AND SUPPORT POLICY, IF ANY. NETWORK ASSIGNS AND PASSES THROUGH TO THE USER MAKING A PURCHASE ANY WARRANTY OF THE MANUFACTURER, AND SUCH USER ACKNOWLEDGES THAT HE/SHE SHALL HAVE RECOURSE ONLY UNDER SUCH WARRANTIES AND ONLY AS AGAINST THE MANUFACTURER OF THE MERCHANDISE. NETWORK MAKES NO REPRESENTATION OR EXPRESS WARRANTY WITH RESPECT TO MERCHANDISE EXCEPT THOSE STATED IN THESE PURCHASE POLICIES. NETWORK DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, AS TO ANY MERCHANDISE PURCHASED THROUGH THE SITE, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY IMPLIED WARRANTIES ARISING FROM STATUTE, TRADE USAGE, COURSE OF DEALING, OR COURSE OF PERFORMANCE.
TERMINATION
You acknowledge that Network may terminate access to the Streaming Service as set forth in these Purchase Policies. In the event of termination those portions of these Purchase Policies that provide for continuing obligations on your part shall survive indefinitely.
ASSIGNMENT
You may not assign or transfer your rights or the license granted to you under these Purchase Policies without Network’s express, prior written consent. Any attempt to assign or transfer your rights or license shall be null and void.
PRICES
Prices, including, without limitation, Fees, are subject to change at any time without notice to you. In addition, there may be pricing or other errors at the Site.
SHIPPING
Your total Merchandise purchase price will include applicable shipping and handling charges.
TAXES
All Merchandise orders and Streaming Service subscriptions will have the applicable sales tax added.
RISK OF LOSS
Merchandise is shipped to you pursuant to a shipping contract. With respect to Merchandise, title and risk of loss shall pass to you upon Network’s delivery of such Merchandise to a common carrier.
COMPLIANCE WITH LAWS
You agree to use the Streaming Service and Merchandise you may purchase at the Site in compliance with all applicable laws, rules, regulations and ordinances.
